Introduction
These Terms of Service ("Terms") govern access to and use of Lexsis AI, operated by AETHERIA LABS PRIVATE LIMITED ("Lexsis", "we", "our", or "us"). Lexsis is an ecommerce growth platform for consumer brands, supporting AI-search visibility, storefront and landing-page workflows, experimentation, tracking, attribution, and connected ecommerce and marketing data.
By accessing www.trylexsis.com, installing the Lexsis Shopify app, creating an account, or using the Services, you agree to these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Services.
Definitions
- "Platform" means the Lexsis web application, Shopify app, APIs, integrations, and related services.
- "Services" means the features and functionality Lexsis makes available, including AI-visibility analysis, storefront and landing-page generation and editing, publishing workflows, experimentation, analytics, tracking, attribution, integrations, and reporting.
- "Customer" means the business or person that opens an account, installs the Shopify app, or otherwise subscribes to the Services.
- "Customer Data" means data a Customer uploads, connects, authorizes, or generates through the Services, including Shopify and other Connected Source data.
- "Connected Sources" means third-party services, platforms, and data sources a Customer authorizes Lexsis to access.
- "Authorized User" means a person a Customer permits to use the Services on its behalf.
Eligibility and Accounts
You may use the Services only if you can form a binding agreement and have authority to accept these Terms for the Customer. You must provide accurate, current account information, keep credentials confidential, and promptly notify us of suspected unauthorized access. The Customer is responsible for activity under its account and for its Authorized Users.
Description of the Services
Lexsis helps ecommerce and consumer-brand teams monitor how brands and products appear in AI-search and recommendation environments, create and evaluate storefront experiences, and measure selected performance outcomes.
Available features may include:
- AI-visibility monitoring, diagnostics, citation and competitor analysis
- Shopify catalog and storefront workflows
- Storefront and landing-page creation, editing, preview, publishing, versioning, and quality checks
- Experiments, analytics, tracking, attribution, and reporting
- Connections to approved ecommerce, review, analytics, advertising, search, lifecycle, support, and collaboration tools
- MCP-enabled workflows that let compatible agent tools assist with supported page planning, generation, validation, preview, and publishing
Feature availability varies by plan, enabled connections, product configuration, and rollout status. Lexsis may change, improve, or discontinue features in accordance with these Terms.
Ecommerce Connections and Connected Sources
Lexsis connects with a Customer's existing ecommerce platform and marketing stack. Shopify and Shopify Plus are supported connections today; Lexsis may support additional commerce platforms and connections over time. Connections do not transfer ownership of, replace, or operate the Customer's ecommerce account, theme, checkout, payments, tax, fulfillment, inventory, or other commerce operations unless separately agreed in writing.
By installing the Shopify app or connecting another Connected Source, the Customer authorizes Lexsis to access and process the data made available through the permissions the Customer grants, solely to provide the enabled Services. The Customer may remove a connection or uninstall the Shopify app, subject to any retention and deletion obligations in the applicable agreement.
The Customer is responsible for:
- Reviewing the requested app and Connected Source permissions before authorizing access
- Maintaining its ecommerce store, checkout, theme, customer notices, consent settings, and required merchant policies
- Confirming that its connected data, configuration, content, offers, tracking, and use of the Services comply with applicable law and third-party terms
- Testing and approving any storefront, content, experiment, integration, tracking, or publication change before it reaches production traffic
Customer Data
Customer retains ownership of Customer Data. Customer grants Lexsis a limited, non-exclusive right to host, process, transmit, and use Customer Data only as necessary to provide, secure, support, and improve the Services, comply with law, and enforce these Terms.
Customer represents that it has all rights, notices, permissions, and lawful bases needed to provide Customer Data to Lexsis and to instruct Lexsis to process it. Customer will not use the Services to submit unlawful, malicious, infringing, or sensitive data not appropriate for the enabled feature.
AI Features and Customer Review
Lexsis may use AI systems to provide analysis, recommendations, generated pages or content, and workflow assistance. AI-generated output can be inaccurate, incomplete, or unsuitable for a particular context.
The Customer is responsible for reviewing and approving all output before use or publication, including product facts, health or other regulated claims, prices, offers, availability, legal notices, accessibility, tracking, consent behavior, and Shopify checkout handoff. Lexsis does not guarantee that generated or recommended work will improve search visibility, conversion, revenue, or any other business outcome.
MCP-enabled and other agent-assisted workflows operate only within the features and permissions the Customer enables. The Customer remains responsible for the agent, instructions, approvals, and resulting changes.
Acceptable Use
You may use the Services only in compliance with these Terms and applicable law. You must not:
- Use the Services for unlawful, deceptive, harmful, or infringing activity
- Interfere with, disrupt, reverse engineer, or attempt unauthorized access to the Platform or another user's data
- Upload malware, abuse rate limits, send spam, or use automated means to scrape the Platform without permission
- Circumvent security, consent, authorization, data-protection, or access-control measures
- Use the Services to generate or publish content that violates law, third-party rights, or applicable Shopify or Connected Source terms
We may suspend or limit access where we reasonably believe use violates these Terms, threatens security, or harms the Services or others.
Data Protection and Security
Our processing of Personal Data is described in our Privacy Policy and, where applicable, our Data Processing Addendum.
Lexsis maintains technical and organizational safeguards designed to protect Customer Data, including measures for secure transmission, storage, credential handling, access control, monitoring, and incident response. No system is completely secure, and we do not guarantee absolute security.
Integrations and Third-Party Services
Connected Sources are governed by their own terms, policies, availability, and security practices. We are not responsible for third-party services, including changes to their APIs, permissions, or functionality.
The Customer is responsible for obtaining and maintaining all permissions needed for a Connected Source and for validating the data, events, and outcomes in its own Shopify, analytics, advertising, and other systems.
Intellectual Property
Lexsis and its licensors retain all rights in the Platform, software, models, documentation, trademarks, and other Lexsis materials. Subject to these Terms and payment of applicable fees, we grant Customer a limited, non-transferable, non-sublicensable right for Authorized Users to access and use the Services during the subscription term.
Customer owns its Customer Data. Customer may use the output it lawfully creates through the Services, subject to third-party rights and these Terms. The underlying Platform and its technology remain Lexsis property.
Subscription, Billing, and Fair Use
Some Services require a paid subscription. Fees, included usage, payment terms, and plan-specific features are shown at purchase, in an order form, or in the applicable subscription terms.
Fees are non-refundable except where required by law or expressly agreed in writing. We may change pricing or plan features with reasonable advance notice for a future renewal or billing period.
We may apply reasonable rate limits, usage thresholds, or safeguards to protect the Platform. We will not impose per-seat charges unless expressly stated in the applicable plan or order form.
Service Changes and Availability
We may modify, update, or discontinue the Services. Where a change materially reduces a paid Service during an active term, we will use reasonable efforts to provide notice.
The Services are provided on an "as available" basis. We do not guarantee continuous, error-free, or uninterrupted availability, a particular feature, or a specific business result. Planned maintenance may occur, and third-party outages or Customer configuration may affect the Services.
Suspension and Termination
We may suspend or terminate access if the Customer violates these Terms, fails to pay applicable fees, creates a security or legal risk, or uses the Services abusively.
Customer may stop using the Services at any time. On expiration or termination, access ends and Customer Data will be returned or deleted in accordance with the applicable agreement, the Privacy Policy, and applicable law.
Disclaimers
To the maximum extent permitted by law, the Services and all output are provided "as is" and "as available," without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Lexsis does not warrant that any AI analysis, generated content, page, experiment, tracking configuration, or recommendation will be accurate, complete, lawful, error-free, available, indexed, cited, or successful. The Customer should independently review and validate output before relying on or publishing it.
Limitation of Liability
To the maximum extent permitted by law, Lexsis will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.
Lexsis's total liability arising out of or related to the Services or these Terms will not exceed the fees paid by Customer for the Services in the 12 months before the event giving rise to liability.
Indemnification
Customer will indemnify and hold harmless Lexsis, AETHERIA LABS PRIVATE LIMITED, and their officers, directors, and employees from claims, losses, liabilities, and expenses arising from Customer Data, Customer's use of the Services, Customer's breach of these Terms, or Customer's violation of law or third-party rights.
Governing Law and Disputes
These Terms are governed by the laws of India. The parties will first attempt in good faith to resolve a dispute for 30 days. If unresolved, disputes will be settled by binding arbitration in Pune, Maharashtra, India under the Arbitration and Conciliation Act, 1996. Courts in Pune, Maharashtra, India have exclusive jurisdiction for matters not subject to arbitration.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted here with a new "Last updated" date. Material changes will be communicated through the Platform or by email where required. Continued use after the effective date means the Customer accepts the updated Terms.
